
The Trump Administration on Wednesday evening filed an emergency appeal asking the Supreme Court to intervene after a Biden-appointed judge ordered the Admin to pay $2 billion in foreign contracts by midnight tonight.
The DC Circuit Court of Appeals has not yet ruled on Trump’s emergency request for an administrative stay so the DOJ went right to the high court as the midnight deadline looms.

Trump’s DOJ on Wednesday morning asked the Court to grant an immediate administrative stay of the lower court’s order and a stay pending appeal.
DOJ lawyers blasted the Biden appointed judge for his “intrusive and profoundly erroneous” order.
“The district court’s order is incredibly intrusive and profoundly erroneous. It appears to contemplate the immediately outlay of nearly $2 billion. The government has no practical mechanism to recover wrongfully disbursed funds that go out the door to entities that have complained that they are near insolvency. And the district court’s broad exercise of jurisdiction, resolving monetary claims beyond its proper authority and addressing the hypothetical claims of parties not before the court, was without legal basis. The district court’s order should be stayed pending appeal. In addition, the order should be immediately administratively stayed,” Trump’s DOJ argued in its emergency motion reviewed by The Gateway Pundit.
Biden-appointed Judge Amir Ali on Tuesday blasted DOJ lawyers over USAID disbursement and ordered the Trump Administration to pay the foreign contracts by 11:59 pm on Wednesday evening.
Earlier this month Judge Amir Ali temporarily blocked President Trump from cancelling foreign aid contracts – these contracts were approved before Trump even took office.
Judge Ali ordered the Trump Admin to restore funding for the foreign aid contractors after Trump froze US foreign aid for 90 days last month.
Non-profit groups sued to have their funds restored.
A couple of weeks ago Judge Amir Ali, said Trump’s order halting foreign funding has caused enormous harm.
“At least to date, Defendants have not offered any explanation for why a blanket suspension of all congressionally appropriated foreign aid, which set off a shockwave and upended reliance interests for thousands of agreements with businesses, nonprofits, and organizations around the country, was a rational precursor to reviewing programs,” Judge Ali wrote in a 15-page order reviewed by The Gateway Pundit.
On Tuesday, Judge Ali dressed down DOJ lawyers and strong-armed the Trump Administration over the disbursement of funds.
“I don’t know why I can’t get a straight answer from you. Are you aware of an unfreezing of the disbursement of funds for those contracts and agreements that were frozen before Feb. 13?” Judge Ali said to the DOJ lawyers during Tuesday’s emergency hearing.
