
US District Judge Beryl Howell, an Obama appointee, rejected the Trump DOJ’s motion to disqualify her from the Perkins Coie case.
Last week the Trump DOJ moved to disqualify corrupt Obama Judge Beryl Howell from the Perkins Coie case for repeatedly demonstrating “partiality against and animus towards the president.”
Earlier this month, President Trump stripped security clearances of the employees at DNC law firm Perkins Coie.
Judge Beryl Howell blocked part of President Trump’s executive order barring employees from DNC law firm Perkins Coie from entering federal buildings.
Beryl Howell granted Perkins Coie’s request for a TRO for part of Trump’s executive order and said the president violated the law firm’s due process.
“Howell granted the firm’s request for a temporary restraining order for some sections of Trump’s order. The parts being blocked include its limitations on government contracts with clients of the firm and the potential restrictions it puts on the firm’s employees, such as bans on hiring those employees for government positions or barring their access to federal buildings,” CNN reported.
Beryl Howell told the DOJ lawyer that it sent “chills down my spine” to hear that Trump has the power to bar government business with any company it chooses.
“Your view is, ‘Don’t be chilled, judge. You can just trust the president to draw the right line, and yes, he has that power?’” Howell asked, according to CNN. “And that’s the government’s position here?”
In its motion do disqualify Judge Howell, the DOJ said reasonable observers may view this Court as “insufficiently impartial to adjudicate” the challenges to Trump.
“Fair proceedings free from any suggestion of impartiality are essential to the integrity of our country’s judiciary and the need to curtail ongoing improper encroachments of President Trump’s Executive Power playing out across the country. In this case, reasonable observers may well view this Court as insufficiently impartial to adjudicate the meritless challenges to President Trump’s efforts to implement the agenda that the American people elected him to carry out,” the DOJ wrote.
The DOJ argued the Judge Howell must recuse herself because of her personal bias against Trump.
“Recusal is mandatory where a judge’s “impartiality might reasonably be questioned.” 28 U.S.C. § 455(a) (explaining that a federal judge “shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned”). A judge also “shall” recuse where she “has a personal bias or prejudice concerning a party.”” the DOJ wrote.
In its motion to disqualify the judge, the Trump DOJ included recent video of Beryl Howell going on a crazy tirade against Trump.

Judge Howell attacked the DOJ in her 21-page memorandum on Wednesday.
“When the U.S. Department of Justice engages in this rhetorical strategy of ad hominem attack, the stakes become much larger than only the reputation of the targeted federal judge. This strategy is designed to impugn the integrity of the federal judicial system and blame any loss on the decision-maker rather than fallacies in the substantive legal arguments presented,” Judge Howell wrote.
